LPU Violence: High Court Says Punjab Probe Falls Short

The Punjab and Haryana High Court on Monday said the Punjab Police probe into last month's violence at Lovely Professional University (LPU) "falls much short" of expectations, but gave the state one more chance before deciding on a CBI transfer. The matter returns on October 27, Bar & Bench, LiveLaw and The Tribune reported.

What did the High Court say about the LPU probe?

A bench of Chief Justice Ashwani Kumar Mishra and Justice Rohit Kapoor was hearing a PIL by LPU student Ravi Raj seeking a CBI probe. The court asked why a "non-existent event" was shared on social media to create unrest and said this must be dealt with on priority. It noted three police vehicles were torched, several policemen were injured and public property and malls suffered damage of over Rs 30 crore, and said the steps taken "fall short of expectation".

Why did the court question the student's examination?

The Tribune reported that the bench observed an 18-year-old first-year student, who had forwarded the post claiming two girls were sexually assaulted and murdered, had not been properly questioned. The state's counsel said she had no mens rea, or criminal intent, and a sealed report was handed over, but the bench found her statement was missing from it. The court stressed the need to find out whether someone used her or accessed her phone to spread the message.

What has the court ordered?

The bench said it was giving the state another opportunity before considering the plea to transfer the probe to an independent agency. It expects police to apprehend whoever is behind the false narrative, and, according to Bar & Bench, directed that the probe be supervised by a senior counter-intelligence officer of Punjab Police. The state told the court it will write to all social media platforms, including Google, to take down posts about the non-existent incident. Additional Advocate General Chanchal K Singla said the ADGP Cyber Crime is probing the issue and its scope has been enlarged.

What does the petition allege?

The petition claims a large number of outsiders joined the violence and that it was a planned attack. These are the petitioner's allegations and have not been proven. Police have so far not established that the alleged rape took place. It also refers to similar unrest at Chitkara University, Rajpura, a night earlier, where the university and police said no such incident had occurred.

When is the next LPU hearing?

The High Court will hear the case again on October 27, 2026.

Is the CBI probe ordered yet?

No. The court has not transferred the probe to the CBI; it gave the Punjab Police another opportunity first.

ਦ ਟ੍ਰਿਬਿਊਨ ਮੁਤਾਬਕ ਬੈਂਚ ਨੇ ਕਿਹਾ ਕਿ ਜਿਸ 18 ਸਾਲਾ ਪਹਿਲੇ ਸਾਲ ਦੀ ਵਿਦਿਆਰਥਣ ਨੇ ਦੋ ਕੁੜੀਆਂ ਨਾਲ ਜਿਨਸੀ ਸ਼ੋਸ਼ਣ ਤੇ ਕਤਲ ਦਾ ਦਾਅਵਾ ਕਰਦੀ ਪੋਸਟ ਅੱਗੇ ਭੇਜੀ ਸੀ, ਉਸ ਤੋਂ ਠੀਕ ਤਰ੍ਹਾਂ ਪੁੱਛਗਿੱਛ ਨਹੀਂ ਹੋਈ। ਸਰਕਾਰੀ ਵਕੀਲ ਨੇ ਕਿਹਾ ਕਿ ਉਸ ਦੀ ਕੋਈ ਅਪਰਾਧਿਕ ਮਨਸ਼ਾ ਨਹੀਂ ਸੀ ਅਤੇ ਸੀਲਬੰਦ ਰਿਪੋਰਟ ਦਿੱਤੀ ਗਈ, ਪਰ ਬੈਂਚ ਨੇ ਪਾਇਆ ਕਿ ਉਸ ਦਾ ਬਿਆਨ ਉਸ ਵਿੱਚ ਨਹੀਂ ਸੀ। ਅਦਾਲਤ ਨੇ ਜ਼ੋਰ ਦਿੱਤਾ ਕਿ ਇਹ ਪਤਾ ਲਾਇਆ ਜਾਵੇ ਕਿ ਕੀ ਕਿਸੇ ਨੇ ਉਸ ਨੂੰ ਵਰਤਿਆ ਜਾਂ ਉਸ ਦੇ ਫ਼ੋਨ ਰਾਹੀਂ ਸੁਨੇਹਾ ਫੈਲਾਇਆ।

ਬੈਂਚ ਨੇ ਕਿਹਾ ਕਿ ਜਾਂਚ ਸੁਤੰਤਰ ਏਜੰਸੀ ਨੂੰ ਸੌਂਪਣ ਦੀ ਮੰਗ 'ਤੇ ਵਿਚਾਰ ਤੋਂ ਪਹਿਲਾਂ ਉਹ ਸਰਕਾਰ ਨੂੰ ਇੱਕ ਹੋਰ ਮੌਕਾ ਦੇ ਰਿਹਾ ਹੈ। ਬਾਰ ਐਂਡ ਬੈਂਚ ਮੁਤਾਬਕ ਜਾਂਚ ਦੀ ਨਿਗਰਾਨੀ ਪੰਜਾਬ ਪੁਲਿਸ ਦੇ ਕਾਊਂਟਰ-ਇੰਟੈਲੀਜੈਂਸ ਦੇ ਸੀਨੀਅਰ ਅਧਿਕਾਰੀ ਕਰਨਗੇ। ਸਰਕਾਰ ਨੇ ਦੱਸਿਆ ਕਿ ਉਹ ਗੂਗਲ ਸਮੇਤ ਸਾਰੇ ਸੋਸ਼ਲ ਮੀਡੀਆ ਪਲੇਟਫਾਰਮਾਂ ਨੂੰ ਨਾ-ਵਾਪਰੀ ਘਟਨਾ ਵਾਲੀਆਂ ਪੋਸਟਾਂ ਹਟਾਉਣ ਲਈ ਲਿਖੇਗੀ। ਵਧੀਕ ਐਡਵੋਕੇਟ ਜਨਰਲ ਚੰਚਲ ਕੇ ਸਿੰਗਲਾ ਨੇ ਕਿਹਾ ਕਿ ਏਡੀਜੀਪੀ ਸਾਈਬਰ ਕ੍ਰਾਈਮ ਜਾਂਚ ਕਰ ਰਹੇ ਹਨ ਅਤੇ ਦਾਇਰਾ ਵਧਾਇਆ ਗਿਆ ਹੈ।

ਪਟੀਸ਼ਨ ਵਿੱਚ ਕੀ ਦੋਸ਼ ਹਨ?
