Supreme Court: Converts Can't Claim Quota Based on Pre-Conversion Backwardness

The Supreme Court ruled on Thursday, October 15, 2026, that a Hindu from a backward community does not automatically become a member of a backward Muslim community by converting to Islam, and that pre-conversion backwardness cannot be carried into a new faith to claim reservation, according to LiveLaw, The Hindu and ThePrint.
What did the Supreme Court decide?
A bench of Justices Prashant Kumar Mishra and Shree Chandrashekhar dismissed an appeal by the Tamil Nadu government and upheld a Madras High Court judgment. The court held that a person who converts from the Hindu social order to a non-Hindu social order cannot claim affirmative action under Article 16(4) of the Constitution merely on the basis of social backwardness linked to the earlier status. Justice Mishra wrote that conversion "severs the legal foundation" of an entitlement tied to membership of the Hindu social order.
What was the Tamil Nadu order that fell?
The case concerned a March 9, 2024 government order that let people converting to Islam from Backward Classes, Most Backward Classes, Denotified Communities or Scheduled Castes be treated as BC (Muslim) and receive a community certificate placing them in one of seven notified Muslim groups: Ansar, Dekkani Muslims, Dubekula, Labbais (including Rowthar and Marakayar), Mapilla, Sheik and Syed. The Madras High Court struck the order down as unconstitutional. The Supreme Court said its defect ran deeper than one wrongly issued certificate, because it treated disadvantage suffered in one religion as proof of membership of a particular class in another.
What happens to Scheduled Caste status?
The judgment said the Constitution (Scheduled Castes) Order, 1950 does not treat a person professing a religion other than Hinduism, Sikhism or Buddhism as a Scheduled Caste member. A convert to Islam, Christianity or another such faith therefore ceases to hold Scheduled Caste status and cannot claim benefits tied to it. The court also noted that Scheduled Caste status is governed by Article 341, under which only the President can notify a group, so a state cannot alter or recreate it by executive order.
What about people who return to Hinduism?
Where a person converts and later reconverts, the court said entitlement cannot be decided merely by their antecedent status. It requires an independent, fact-specific assessment of whether the original caste or social identity has genuinely revived and whether the person meets the legal requirements.
Who brought the case, and what was the reaction?
The dispute began with Sameer Ahamed, a Thoothukudi resident born to Hindu parents, who converted to Islam in 2015. His request for a "Muslim Lebbai" community certificate was rejected by the tahsildar, and he moved the High Court. The court also said a religious body such as a Jamath can certify a conversion but cannot conclusively decide statutory backward-class status. Former Tamil Nadu Chief Minister M.K. Stalin urged the state government to file a Special Leave Petition in the Supreme Court to protect the reservation rights of converted Backward Class members.
Why does it matter beyond Tamil Nadu?
Reservation lists differ from state to state, and several states recognise Muslim and Christian communities as backward classes. The court's reading that conversion does not by itself confer membership of a notified community is likely to be cited in similar disputes elsewhere. The judgment relied on the recent Chinthada Anand v. State of Andhra Pradesh decision, which held that conversion to Islam or Christianity leads to loss of Scheduled Caste status.
Does the ruling cover Sikhs?
The Scheduled Castes Order the court cited names Hindus, Sikhs and Buddhists as the faiths whose members can hold Scheduled Caste status. The ruling concerns conversion to a religion outside that list, such as Islam or Christianity.
Can a convert to Islam claim OBC reservation after this ruling?
Not merely on the basis of the backwardness attached to their earlier status, the Supreme Court held. Conversion does not by itself make a person a member of any notified backward class community in the new faith.
Which case did the Supreme Court decide?
It was The Secretary to Government v. Sameer Ahamed, an appeal against a Madras High Court judgment that had quashed the Tamil Nadu government's 2024 order.
Who can notify Scheduled Caste status?
Under Article 341, only the President can notify a group as a Scheduled Caste, the court noted, so a state government cannot change or recreate that status by an executive order.
