Breaking-news poster: Supreme Court quashes Yes Bank's Rs 8,415 crore AT-1 bond write-off

The Supreme Court on Thursday, October 15, 2026, upheld a Bombay High Court ruling that struck down Yes Bank's write-off of Additional Tier-1 (AT-1) bonds worth Rs 8,415 crore, holding that the bank's administrator had no power to extinguish them under the 2020 rescue plan. Yes Bank shares fell sharply on the day.

A bench of Justices Dipankar Datta and Augustine George Masih dismissed the appeals filed by Yes Bank, the Reserve Bank of India (RBI) and the Union government against the High Court's January 2023 judgment, LiveLaw and Bar & Bench reported.

What did the Supreme Court decide?

The court held that the administrator appointed under the Banking Regulation Act has to act strictly within the powers the law gives him, and that any act beyond those powers is illegal and void. The draft reconstruction scheme had allowed a permanent write-down of AT-1 bonds, but that clause was left out of the final scheme notified on March 13, 2020. The administrator nevertheless wrote the bonds down the next day, according to LiveLaw.

The bench also read RBI's Master Circular on Basel III capital rules to mean that any conversion or write-down at the point of non-viability had to happen before the reconstruction scheme took effect.

What did the judges say about RBI and Yes Bank?

The judgment was sharply worded. "The RBI was a mere bystander," the bench said, as the bank's core capital ratio (CET1) fell to 0.6% while its business was run in a "clandestine manner". It added that making investors bear the cost of administrative lapses "would be highly unfair".

The court also criticised Yes Bank for offering these high-risk bonds directly to individual investors, saying this went against the Master Circular, which contemplates such instruments being sold to institutional investors.

How big is the amount and how did the market react?

The write-off covered two issues: Rs 3,000 crore of 9.5% bonds issued in December 2016 and Rs 5,415 crore of 9% bonds issued in October 2017, The Economic Times reported. Yes Bank shares were down about 14% at Rs 18.21 on the NSE by 3:06 pm, Business Standard reported.

Yes Bank told the stock exchanges it was examining the judgment and would make further disclosures as required. The Economic Times noted that the verdict does not order an immediate cash repayment of Rs 8,415 crore and does not put a figure on past coupon interest. Lawyers quoted by The Financial Express said the bonds should now be restored and accrued interest from 2020 may become payable; that is their reading, and the bank has not confirmed any liability.

Why does the Yes Bank AT-1 case matter?

AT-1 bonds are risky bank-capital instruments that can be written down when a bank is in trouble. The 2020 rescue, backed by a consortium led by State Bank of India, wiped out these bonds. Many individual investors and institutions lost money, and the ruling is now seen as a boost for them and a test for how future bank rescues are designed.

What happens next for Yes Bank bondholders?

That depends on how Yes Bank and RBI implement the order after studying the full judgment. The bank has not yet said how it will restore the bonds or pay interest.

What was the Yes Bank AT-1 bond write-off?

It was the March 2020 decision by Yes Bank's administrator to permanently write down AT-1 bonds worth Rs 8,415 crore during the bank's RBI-led rescue.

Which court cancelled the write-off?

The Bombay High Court quashed it in January 2023, and the Supreme Court upheld that ruling on October 15, 2026.

Does Yes Bank have to repay Rs 8,415 crore immediately?

No immediate repayment was ordered, according to The Economic Times; the bank said it is studying the judgment.
