High Court Orders CBI Inquiry Into Hoshiarpur Illegal Mining

The Punjab and Haryana High Court has directed the CBI to conduct a preliminary inquiry into alleged large-scale illegal mining in Hoshiarpur district, reports said on Friday, October 9. A bench of Chief Justice Ashwani Kumar Mishra and Justice Rohit Kapoor also ordered a drone survey and 3D satellite imagery of the affected area.

What did the High Court order?

The bench said it was "prima facie convinced" that the authorities responsible for preventing such mining "have utterly failed to carry out their responsibilities". It said allegations of collusion between state authorities and those behind the destruction could not be brushed aside lightly, and asked the CBI to identify everyone responsible. The CBI may take help from the district administration, the mines and geology department and expert bodies. Punjab must bear all costs.

What did the inspection find?

A September 14 report by the Chief Judicial Magistrate-cum-Secretary of the Hoshiarpur District Legal Services Authority confirmed large-scale mining in villages including Sandhwal, Naushahra Simbli, Dewal, Sariana, Bhatehar, Dhol Kalota and Alera. Excavation depths ranged from 20 to 110 feet, and at some sites the depth could not be measured because pits were waterlogged or inaccessible. The report also recorded alleged attempts to divert the inspection team away from the actual mining spots.

What did the state tell the court?

In an affidavit, the district mining officer said none of the approved commercial, landowner or crusher mining sites in the district was operational. The state also said 31 stone crushers were registered, of which 26 were working. The court noted that no credible data explained where the raw material for those crushers came from.

Who brought the petition?

The petition was filed by Rahul Manchanda under Article 226 of the Constitution, seeking a time-bound, impartial probe and alleging connivance by officials of the mines department and the Punjab Pollution Control Board. The state questioned his locus, and the bench said it was not satisfied with his credentials but took up the case because of the larger public interest.
