Punjab Gives Senior Police PIT-NDPS Detention Powers

The Punjab government has delegated preventive-detention powers against drug traffickers to its senior police officers, a day after Union Home Minister Amit Shah said Punjab had not used a stringent anti-narcotics law, The Tribune and The Times of India reported on 23 October 2026. A notification issued by the Home Affairs department on 21 October covers the Prevention of Illicit Traffic in Narcotic Drugs and Psychotropic Substances (PIT-NDPS) Act, 1988.

What does the notification change?

According to The Tribune, police commissioners, Inspector Generals and officers of Additional DGP rank and above can now order preventive detention of drug smugglers for a specified period. Earlier, only the state Home Secretary held this authority. Encounter News reported that six named IPS officers, from a Special DGP to an IG, are specially empowered in units where no IG-rank officer is posted, and that the DGP will allocate their jurisdictions.

Why now?

On 20 October, Shah said at a Ludhiana press conference that 929 cases had been registered under the Act across India while Punjab had registered none, The Tribune reported. The paper added that sources said the state had ordered preventive detention in seven cases till last month. The state government has not linked the notification to Shah's remarks, and Encounter News noted the order does not mention the killing of anti-drug activist Parvinder Singh Jhota.

How will it work on the ground?

An ADGP-rank officer told The Tribune that approvals used to take months. Under the new order, warrants can be executed at district and commissionerate level with the consent of an IG-rank officer or above. Police have been told to use the powers in "good spirit". A senior official said a 20-item checklist for proposing detention remains hard to meet and urged fresh, simpler procedures.

What is the PIT-NDPS Act?

It lets authorities detain a person to prevent them from trafficking in narcotics. Once an order is issued, illegally acquired property of the person, relatives and associates can be seized, frozen and forfeited, the Tribune explained. Encounter News stressed that it is separate from ordinary criminal cases under the NDPS Act, 1985.

ਟ੍ਰਿਬਿਊਨ ਮੁਤਾਬਕ ਪੁਲਿਸ ਕਮਿਸ਼ਨਰ, ਆਈਜੀ ਤੇ ਵਧੀਕ ਡੀਜੀਪੀ ਜਾਂ ਉਸ ਤੋਂ ਉਪਰਲੇ ਰੈਂਕ ਦੇ ਅਧਿਕਾਰੀ ਹੁਣ ਨਸ਼ਾ ਤਸਕਰਾਂ ਨੂੰ ਤੈਅ ਮਿਆਦ ਲਈ ਰੋਕਥਾਮੀ ਹਿਰਾਸਤ ਵਿੱਚ ਲੈਣ ਦੇ ਹੁਕਮ ਦੇ ਸਕਦੇ ਹਨ। ਪਹਿਲਾਂ ਇਹ ਅਧਿਕਾਰ ਸਿਰਫ਼ ਸੂਬੇ ਦੇ ਗ੍ਰਹਿ ਸਕੱਤਰ ਕੋਲ ਸੀ। ਐਨਕਾਊਂਟਰ ਨਿਊਜ਼ ਅਨੁਸਾਰ ਜਿੱਥੇ ਆਈਜੀ ਰੈਂਕ ਦਾ ਅਧਿਕਾਰੀ ਤਾਇਨਾਤ ਨਹੀਂ, ਉੱਥੇ ਛੇ ਨਾਮਜ਼ਦ ਆਈਪੀਐਸ ਅਧਿਕਾਰੀਆਂ ਨੂੰ ਖ਼ਾਸ ਤੌਰ ਉੱਤੇ ਇਹ ਸ਼ਕਤੀਆਂ ਮਿਲੀਆਂ ਹਨ ਅਤੇ ਉਨ੍ਹਾਂ ਦੇ ਅਧਿਕਾਰ ਖੇਤਰ ਡੀਜੀਪੀ ਵੰਡਣਗੇ।

ਹੁਣ ਕਿਉਂ?

ਟ੍ਰਿਬਿਊਨ ਮੁਤਾਬਕ 20 ਅਕਤੂਬਰ ਨੂੰ ਲੁਧਿਆਣਾ ਵਿੱਚ ਪ੍ਰੈੱਸ ਕਾਨਫਰੰਸ ਦੌਰਾਨ ਸ਼ਾਹ ਨੇ ਕਿਹਾ ਕਿ ਦੇਸ਼ ਭਰ ਵਿੱਚ ਇਸ ਐਕਟ ਤਹਿਤ 929 ਕੇਸ ਦਰਜ ਹੋਏ, ਪਰ ਪੰਜਾਬ ਵਿੱਚ ਇੱਕ ਵੀ ਨਹੀਂ। ਅਖ਼ਬਾਰ ਨੇ ਸੂਤਰਾਂ ਦੇ ਹਵਾਲੇ ਨਾਲ ਇਹ ਵੀ ਲਿਖਿਆ ਕਿ ਪਿਛਲੇ ਮਹੀਨੇ ਤੱਕ ਸੂਬੇ ਨੇ ਸੱਤ ਮਾਮਲਿਆਂ ਵਿੱਚ ਰੋਕਥਾਮੀ ਹਿਰਾਸਤ ਦੇ ਹੁਕਮ ਦਿੱਤੇ ਸਨ। ਸਰਕਾਰ ਨੇ ਨੋਟੀਫਿਕੇਸ਼ਨ ਨੂੰ ਸ਼ਾਹ ਦੇ ਬਿਆਨ ਨਾਲ ਨਹੀਂ ਜੋੜਿਆ, ਅਤੇ ਐਨਕਾਊਂਟਰ ਨਿਊਜ਼ ਨੇ ਨੋਟ ਕੀਤਾ ਕਿ ਹੁਕਮ ਵਿੱਚ ਨਸ਼ਾ-ਵਿਰੋਧੀ ਕਾਰਕੁਨ ਪਰਵਿੰਦਰ ਸਿੰਘ ਝੋਟਾ ਦੇ ਕਤਲ ਦਾ ਜ਼ਿਕਰ ਨਹੀਂ ਹੈ।

ਇੱਕ ਏਡੀਜੀਪੀ ਰੈਂਕ ਦੇ ਅਧਿਕਾਰੀ ਨੇ ਟ੍ਰਿਬਿਊਨ ਨੂੰ ਦੱਸਿਆ ਕਿ ਪਹਿਲਾਂ ਮਨਜ਼ੂਰੀ ਵਿੱਚ ਮਹੀਨੇ ਲੱਗ ਜਾਂਦੇ ਸਨ। ਨਵੇਂ ਹੁਕਮ ਮੁਤਾਬਕ ਆਈਜੀ ਜਾਂ ਉਸ ਤੋਂ ਉਪਰਲੇ ਅਧਿਕਾਰੀ ਦੀ ਸਹਿਮਤੀ ਨਾਲ ਜ਼ਿਲ੍ਹਾ ਤੇ ਕਮਿਸ਼ਨਰੇਟ ਪੱਧਰ ਉੱਤੇ ਵਾਰੰਟ ਲਾਗੂ ਹੋ ਸਕਣਗੇ। ਪੁਲਿਸ ਨੂੰ ਇਹ ਸ਼ਕਤੀਆਂ "ਚੰਗੀ ਭਾਵਨਾ" ਨਾਲ ਵਰਤਣ ਦੀ ਹਦਾਇਤ ਹੈ। ਇੱਕ ਸੀਨੀਅਰ ਅਧਿਕਾਰੀ ਨੇ ਕਿਹਾ ਕਿ ਹਿਰਾਸਤ ਦਾ ਪ੍ਰਸਤਾਵ ਦੇਣ ਲਈ 20 ਨੁਕਤਿਆਂ ਦੀ ਚੈੱਕਲਿਸਟ ਪੂਰੀ ਕਰਨੀ ਅਜੇ ਵੀ ਔਖੀ ਹੈ ਤੇ ਨਵੀਂ, ਸੌਖੀ ਪ੍ਰਕਿਰਿਆ ਬਣਨੀ ਚਾਹੀਦੀ ਹੈ।

ਇਹ ਕਾਨੂੰਨ ਕਿਸੇ ਵਿਅਕਤੀ ਨੂੰ ਨਸ਼ਿਆਂ ਦੀ ਤਸਕਰੀ ਕਰਨ ਤੋਂ ਰੋਕਣ ਲਈ ਪਹਿਲਾਂ ਹੀ ਹਿਰਾਸਤ ਵਿੱਚ ਲੈਣ ਦੀ ਇਜਾਜ਼ਤ ਦਿੰਦਾ ਹੈ। ਹੁਕਮ ਜਾਰੀ ਹੋਣ ਮਗਰੋਂ ਉਸ ਵਿਅਕਤੀ, ਰਿਸ਼ਤੇਦਾਰਾਂ ਤੇ ਸਾਥੀਆਂ ਦੀ ਨਾਜਾਇਜ਼ ਕਮਾਈ ਵਾਲੀ ਜਾਇਦਾਦ ਜ਼ਬਤ, ਫ੍ਰੀਜ਼ ਜਾਂ ਕੁਰਕ ਹੋ ਸਕਦੀ ਹੈ। ਐਨਕਾਊਂਟਰ ਨਿਊਜ਼ ਮੁਤਾਬਕ ਇਹ 1985 ਦੇ ਐਨਡੀਪੀਐਸ ਐਕਟ ਤਹਿਤ ਆਮ ਫ਼ੌਜਦਾਰੀ ਕੇਸਾਂ ਤੋਂ ਵੱਖਰਾ ਹੈ।
