Justice Nagu Recuses From Punjab's Plea Against CBI Probe

Supreme Court judge Justice Sheel Nagu on Friday recused himself from hearing the Punjab government's appeal against the High Court's order for a CBI probe into corruption allegations linked to Chief Minister Bhagwant Mann's office. The case will now be placed before Chief Justice of India Surya Kant, who will assign it to a fresh bench.

What happened in court?

When the matter came before a bench of Justices Dipankar Datta and Sheel Nagu, Justice Datta said it could not be heard by Justice Nagu. Justice Nagu was Chief Justice of the Punjab and Haryana High Court before moving to the Supreme Court and dealt with several cases involving the AAP-led state government there. Senior advocate Jaideep Gupta, for Punjab, said the state was not relying on any judgment written by Justice Nagu. Justice Datta replied, as reported by PTI and Bar and Bench, "We are in very difficult times... One doesn't know from where the attack will come from. There are 17 other benches."

Where does the case stand?

The Punjab government moved the Supreme Court on October 6 against the High Court's October 5 direction to the CBI to register a case and report back within two months. On Thursday the bench deferred the hearing to Friday and declined to pass any interim order, after Vikas Singh, for Punjab, asked that the CBI and ED not act in the meantime. With the recusal, there is still no stay on the investigation.

What is the CBI probe about?

The High Court acted on three letters the Enforcement Directorate sent to the Punjab DGP, alleging an organised network around the chief minister's office. The CBI registered an FIR against Mann's OSD Rajbir Singh Ghuman and five others and searched several locations in Punjab and Chandigarh. The allegations are unproven, and Ghuman has separately moved the High Court to quash the FIR.

What happens next?

The file goes to the CJI, who will decide which bench hears Punjab's plea. No date had been announced in the reports reviewed.

Why did Justice Nagu step aside?

Reports say it was because of his earlier role as High Court Chief Justice and his past handling of cases involving the Punjab government. No misconduct is alleged.

Does the CBI probe continue?

Yes. The Supreme Court has not stayed the High Court's order, so the CBI investigation stays in force unless a court orders otherwise.

Who will hear Punjab's appeal now?

Chief Justice of India Surya Kant will assign a new bench.

ਜਦੋਂ ਮਾਮਲਾ ਜਸਟਿਸ ਦੀਪਾਂਕਰ ਦੱਤਾ ਅਤੇ ਜਸਟਿਸ ਸ਼ੀਲ ਨਾਗੂ ਦੇ ਬੈਂਚ ਸਾਹਮਣੇ ਆਇਆ, ਤਾਂ ਜਸਟਿਸ ਦੱਤਾ ਨੇ ਕਿਹਾ ਕਿ ਇਸ ਦੀ ਸੁਣਵਾਈ ਜਸਟਿਸ ਨਾਗੂ ਨਹੀਂ ਕਰ ਸਕਦੇ। ਜਸਟਿਸ ਨਾਗੂ ਸੁਪਰੀਮ ਕੋਰਟ ਜਾਣ ਤੋਂ ਪਹਿਲਾਂ ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਹਾਈ ਕੋਰਟ ਦੇ ਚੀਫ਼ ਜਸਟਿਸ ਸਨ ਅਤੇ ਉੱਥੇ 'ਆਪ' ਸਰਕਾਰ ਨਾਲ ਜੁੜੇ ਕਈ ਮਾਮਲੇ ਸੁਣ ਚੁੱਕੇ ਹਨ। ਪੰਜਾਬ ਵੱਲੋਂ ਸੀਨੀਅਰ ਵਕੀਲ ਜੈਦੀਪ ਗੁਪਤਾ ਨੇ ਕਿਹਾ ਕਿ ਸੂਬਾ ਜਸਟਿਸ ਨਾਗੂ ਦੇ ਕਿਸੇ ਫ਼ੈਸਲੇ 'ਤੇ ਨਿਰਭਰ ਨਹੀਂ ਕਰ ਰਿਹਾ। ਪੀਟੀਆਈ ਅਤੇ ਬਾਰ ਐਂਡ ਬੈਂਚ ਮੁਤਾਬਕ ਜਸਟਿਸ ਦੱਤਾ ਨੇ ਕਿਹਾ, "ਅਸੀਂ ਬਹੁਤ ਮੁਸ਼ਕਲ ਸਮੇਂ ਵਿੱਚ ਹਾਂ। ਪਤਾ ਨਹੀਂ ਹਮਲਾ ਕਿੱਥੋਂ ਆਵੇ। ਸਾਡੇ ਕੋਲ 17 ਹੋਰ ਬੈਂਚ ਹਨ।"

ਮਾਮਲਾ ਹੁਣ ਕਿੱਥੇ ਖੜ੍ਹਾ ਹੈ?

ਪੰਜਾਬ ਸਰਕਾਰ ਨੇ 6 ਅਕਤੂਬਰ ਨੂੰ ਸੁਪਰੀਮ ਕੋਰਟ ਦਾ ਰੁਖ਼ ਕੀਤਾ, ਜਿਸ ਵਿੱਚ ਹਾਈ ਕੋਰਟ ਦੇ 5 ਅਕਤੂਬਰ ਦੇ ਉਸ ਨਿਰਦੇਸ਼ ਨੂੰ ਚੁਣੌਤੀ ਦਿੱਤੀ ਗਈ ਜਿਸ ਤਹਿਤ ਸੀਬੀਆਈ ਨੂੰ ਕੇਸ ਦਰਜ ਕਰਨ ਅਤੇ ਦੋ ਮਹੀਨਿਆਂ ਵਿੱਚ ਰਿਪੋਰਟ ਦੇਣ ਲਈ ਕਿਹਾ ਗਿਆ ਸੀ। ਵੀਰਵਾਰ ਨੂੰ ਬੈਂਚ ਨੇ ਸੁਣਵਾਈ ਸ਼ੁੱਕਰਵਾਰ ਤੱਕ ਟਾਲ ਦਿੱਤੀ ਅਤੇ ਕੋਈ ਅੰਤਰਿਮ ਹੁਕਮ ਨਹੀਂ ਦਿੱਤਾ। ਹੁਣ ਜਾਂਚ 'ਤੇ ਕੋਈ ਰੋਕ ਨਹੀਂ ਹੈ।

ਸੀਬੀਆਈ ਜਾਂਚ ਕਿਸ ਬਾਰੇ ਹੈ?

ਹਾਈ ਕੋਰਟ ਨੇ ਈਡੀ ਵੱਲੋਂ ਪੰਜਾਬ ਦੇ ਡੀਜੀਪੀ ਨੂੰ ਭੇਜੀਆਂ ਤਿੰਨ ਚਿੱਠੀਆਂ ਦੇ ਆਧਾਰ 'ਤੇ ਕਾਰਵਾਈ ਕੀਤੀ, ਜਿਨ੍ਹਾਂ ਵਿੱਚ ਮੁੱਖ ਮੰਤਰੀ ਦਫ਼ਤਰ ਦੁਆਲੇ ਸੰਗਠਿਤ ਨੈੱਟਵਰਕ ਦਾ ਦੋਸ਼ ਹੈ। ਸੀਬੀਆਈ ਨੇ ਮਾਨ ਦੇ ਓਐੱਸਡੀ ਰਾਜਬੀਰ ਸਿੰਘ ਘੁੰਮਣ ਅਤੇ ਪੰਜ ਹੋਰਾਂ ਖ਼ਿਲਾਫ਼ ਐੱਫ਼ਆਈਆਰ ਦਰਜ ਕੀਤੀ ਅਤੇ ਪੰਜਾਬ ਤੇ ਚੰਡੀਗੜ੍ਹ ਵਿੱਚ ਕਈ ਥਾਵਾਂ 'ਤੇ ਤਲਾਸ਼ੀ ਲਈ। ਦੋਸ਼ ਸਾਬਤ ਨਹੀਂ ਹੋਏ ਅਤੇ ਘੁੰਮਣ ਨੇ ਐੱਫ਼ਆਈਆਰ ਰੱਦ ਕਰਵਾਉਣ ਲਈ ਹਾਈ ਕੋਰਟ ਵਿੱਚ ਵੱਖਰੀ ਪਟੀਸ਼ਨ ਪਾਈ ਹੈ।

ਅੱਗੇ ਕੀ ਹੋਵੇਗਾ?

ਫ਼ਾਈਲ ਚੀਫ਼ ਜਸਟਿਸ ਕੋਲ ਜਾਵੇਗੀ, ਜੋ ਤੈਅ ਕਰਨਗੇ ਕਿ ਪੰਜਾਬ ਦੀ ਪਟੀਸ਼ਨ ਕਿਹੜਾ ਬੈਂਚ ਸੁਣੇਗਾ। ਜਾਂਚੀਆਂ ਗਈਆਂ ਰਿਪੋਰਟਾਂ ਵਿੱਚ ਅਗਲੀ ਤਾਰੀਖ਼ ਨਹੀਂ ਦੱਸੀ ਗਈ।

ਰਿਪੋਰਟਾਂ ਮੁਤਾਬਕ ਇਸ ਦਾ ਕਾਰਨ ਹਾਈ ਕੋਰਟ ਦੇ ਚੀਫ਼ ਜਸਟਿਸ ਵਜੋਂ ਉਨ੍ਹਾਂ ਦੀ ਪਿਛਲੀ ਭੂਮਿਕਾ ਅਤੇ ਪੰਜਾਬ ਸਰਕਾਰ ਦੇ ਮਾਮਲਿਆਂ ਦੀ ਸੁਣਵਾਈ ਹੈ। ਕਿਸੇ ਗ਼ਲਤ ਵਿਹਾਰ ਦਾ ਦੋਸ਼ ਨਹੀਂ ਹੈ।

ਕੀ ਸੀਬੀਆਈ ਜਾਂਚ ਜਾਰੀ ਹੈ?

ਹਾਂ। ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਹਾਈ ਕੋਰਟ ਦੇ ਹੁਕਮ 'ਤੇ ਰੋਕ ਨਹੀਂ ਲਾਈ, ਇਸ ਲਈ ਜਦੋਂ ਤੱਕ ਕੋਈ ਅਦਾਲਤ ਹੋਰ ਹੁਕਮ ਨਾ ਦੇਵੇ, ਜਾਂਚ ਜਾਰੀ ਰਹੇਗੀ।
